NSW: Woman to sue McDonalds over back injury

A former McDonalds restaurant worker has been given the go-ahead to sue over a severe
back injury she sustained when lifting four crates stacked with hamburger buns.

AZADEH VAGHAR, a 21-year-old university student, applied to the New South Wales Supreme
Court for an extension of time in which to sue Meduri Enterprises Pty Ltd, trading as
McDonalds Family Restaurants.

Master JOANNE HARRISON accepted the evidence of Ms VAGHAR, who said she was a 15-year-old
Sydney schoolgirl when she hurt her back lifting and carrying the four crates on July
4, 1994.

Ms HARRISON says Mr VAGHAR told her supervisor that the load was too heavy to lift
but was told to lift it anyway.

Since then, she has undergone surgery and a doctor has assessed her as having 10 per
cent permanent impairment of back function and a 10 per cent permanent impairment of right
leg function.

Ms HARRISON says if successful in her claim, Ms VAGHAR will be entitled to a substantial
award of damages.
